Cruise Lines International Association (CLIA) presents this privacy policy (together with our Membership Terms and Conditions) will inform you as to how we look after your personal data and tell you about your privacy rights and how the law protects you.

    This privacy policy aims to give you information on how we process the personal data that you provide to us, or we collect from you, when you visit our website www.cruising.org, register to become a member of the CLIA cruise industry trade association (Member, and the term Membership shall be construed accordingly), create a personal profile on our website, sign up to receive our marketing communications, request any of our products or services from us (Services), make an enquiry and/or otherwise interact with us.

    This website is not intended for children and we do not knowingly collect data relating to children.

    It is important that you read this privacy policy together with any other privacy policy or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements the other notices and is not intended to override them.

    Cruise Lines International Association is made up of different legal entities based in North and South America, Europe, Asia and Australia, details of which can be found here (the CLIA Group).

    This privacy policy is issued on behalf of the CLIA Group so when we mention CLIA, we, us or our in this privacy policy, we are referring to the relevant company in the CLIA Group responsible for processing your data (i.e. the controller, for the purposes of European data protection law). We will let you know which entity will be the controller for your data when you register to become a Member or otherwise interact with us.

    Cruise Lines International Association is the controller and responsible for this website.

    We will comply with all data protection and privacy laws which are applicable in the country in which we collect your personal data.

Data and Personal Information

  • The data we collect about you

    Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

    We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

    • Identity Data includes first name, maiden name, last name, username or similar identifier, title, marital status, date of birth, gender, job title, membership reference number, passport details, photograph, training details and accreditations, ABTA membership number, agency name.
    • Contact Data includes billing address, home / office address, email address and telephone numbers.
    • Financial Data includes bank account and payment card details.
    • Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
    • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
    • Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
    • Usage Data includes information about how you use our website, products and services.
    • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
  • Third party personal data that we collect
    When you ask us to register your employees, directors and/or officers (Users) in connection with your Membership, we will need to ask for personal data (including Identity Data and Contact Data) belonging to your Users. It is your obligation to ensure that you make such third parties aware of this Privacy Policy.

    We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

    We may sometimes collect information relating to your dietary requirements, which may reveal details of your religious beliefs and/or medical conditions. We do not collect any other Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

  • If you fail to provide personal data

    Where we need to collect under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with the benefits that you are entitled to as a Member). In this case, we may not be able to provide any product or service that you have requested from us and/or we may have to cancel your Membership (and our standard cancellation terms will apply), but we will notify you if this is the case at the time.

    We use different methods to collect data from and about you including through:

Action tags are 1x1 pixel images embedded in a website page that are used to transparently collect information.     • where we need to comply with a legal or regulatory obligation;
    • For our Members and User, we will send you direct marketing communications via email, telephone, text message and/or post as part of the Services that we provide as part of your Membership (i.e. such processing is necessary for use to perform our contractual obligations to the Member and for legitimate interests in order to provide the User with the benefit of the Services) unless you have told us that you do not want us to contact you for this purpose or by any particular method of communication. If you are not a Member or a User (e.g. if you make an enquiry or otherwise interact with us) we will only send you direct marketing communication where you have provided your explicit consent to such processing of your data.     Third-party marketing

    We will get your express opt-in consent before we share your personal data with any company outside the CLIA Group of companies for marketing purposes.

  • Opting out

    You can ask us or third parties to stop sending you marketing messages at any time by logging into the website and checking or unchecking relevant boxes to adjust your marketing preferences or by following the opt-out links on any marketing message sent to you or by contacting us at any time.

    Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us in connection with your Membership, a product/service purchase or other transactions.

    We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

    This Notice supplements the information contained in CLIA’S Privacy Policy as well as any other privacy notices we may provide, and applies solely to visitors, users, and others who reside in the State of California (“you”). We have adopted this Notice to comply with the California Consumer Privacy Act of 2018, as amended, and implementing regulations (“CCPA”) and other California privacy laws. Any terms defined in the CCPA, other California privacy laws, or in our Privacy Policy have the same meaning when used in this notice.

    This Notice explains how we collect, use, and disclose personal information about California residents when California residents visit our website www.cruising.org, register to become a member of the CLIA cruise industry trade association, create a personal profile on our website, sign up to receive our marketing communications, request any of our products or services from us, make an inquiry and/or otherwise interact with us.     Most Internet browsers are initially set up to accept Cookies, but you can reset your browser to refuse all Cookies or to indicate when a Cookie is being sent.     Action Tags, Web Beacons and other Data Collection Methods. An action tag or a web-beacon (also known as a clear gif or a pixel tag) is a method used to track responses or actions by visitors who view certain advertisements and/or other information on the website. Action tags are 1x1 pixel images embedded in a website page that are used to transparently collect information. We may use action tags to count the number of times that visitors click on a particular banner ad or visit the pages of the website, and to provide information about what offerings, products and/or services are viewed, selected and/or purchased, as applicable.

    • How We Use Personal Information

    We may use, sell, or disclose the Personal Information we collect for one or more of the following business purposes:

    To provide you with information that you may request, to customize your experience on our website and/or to contact you when necessary in connection with transactions entered into by you through the CLIA website or our services. We may also use your Personal Information for internal business purposes, such as analyzing and managing our business.

    We will most commonly use your Personal Information in the following circumstances:

    where it is necessary for us to process your personal data in order to perform our contractual obligations in relation to your CLIA membership (as detailed in our membership terms and conditions or in order to respond to any inquiries that you make about becoming a CLIA member);

    where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;

    where we need to comply with a legal or regulatory obligation;

    For registered members and users, we will send you direct marketing communications via email, telephone, text message and/or post as part of the services that we provide as part of your membership (i.e. such processing is necessary for use to perform our contractual obligations to the member and for legitimate interests in order to provide the user with the benefit of services provided) unless you have told us that you do not want us to contact you for this purpose or by any particular method of communication. If you are not a registered CLIA member or a registered CLIAuser (e.g. if you make an inquiry or otherwise interact with us) we will only send you direct marketing communication where you have provided your explicit consent to such processing of your data. You have the right to withdraw consent to such marketing at any time by contacting us. 

    We will also use your Personal Information to validate or revalidate your travel industry credentials, including but not limited to your CLIA Industry ID Number and/or your CLIA Personal ID Number (also known as “EMBARC ID Number”), to facilitate your establishment or reestablishment of a commercial relationship in which commissions can be paid with travel suppliers such as hotels, car rental companies, etc., as well as global distribution system (GDS) companies.

    1. Sharing or Selling of Personal Information

    We may share your Personal Information with other parties for a business purpose and we may sell your Personal Information to third parties subject to your right to opt-out of those sales (see Personal Information Sales Opt-Out and Opt-In Rights). When we disclose Personal Information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

    1. Notice of the Right To OPT OUT of the Sale of Your Personal Information to Third Parties

    The CCPA prohibits third parties who purchase the Personal Information we hold from reselling it unless you have an opportunity to opt-out of the sale of your information. In the preceding twelve (12) months, we have sold the following categories, or certain components of the following categories, of Personal Information to sellers of travel (including cruise lines and airlines), sellers of accommodations (such as hotel chains):

    1. YOUR RIGHTS AND CHOICES

    The CCPA provides consumers (California residents) with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

    1. Access to Specific Information and Data Portability Rights

    You have the right to request that we disclose certain information to you about our collection, use, disclosure, and/or sale of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights below), we will disclose to you:

    The categories of Personal Information we collected about you;

    The categories of sources for the Personal Information we collected about you;

    Our business or commercial purpose for collecting or selling that Personal Information;

    The categories of third parties with whom we share that Personal Information;

    The specific pieces of Personal Information we collected about you (also called a data portability request); and

    If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing: sales, identifying the Personal Information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

    1. Deletion Request Rights

    You have the right to request that we delete any of your Personal Information that we collected from you and retained in our databases, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

    We may deny your deletion request if retaining the information is necessary for us or our service providers to:

    • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
    • Debug products to identify and repair errors that impair existing intended functionality’
    • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
    • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
    • Comply with a legal obligation;
    • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
    1. Exercising the Right to Know, Access, Data Portability, and Deletion Rights

    To exercise the right to know, access, data portability, and deletion rights described above, please submit a verifiable consumer request to us using one of the following options:

    Only you or a person registered with the California Secretary of State who you authorize to act on your behalf (a.k.a. an “authorized agent”), may make a verifiable consumer request related to your Personal Information. We will use reasonable methods to verify your request or that of your authorized agent including, for example, comparing the email address you used to register on CLIA’s or an affiliated third party’s website.

    You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: 1) Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; 2) Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

    We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Person Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

    1. Response Timing and Format

    We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account or are registered with us, we will deliver our written response to the email address associated with that account or registration. If you do not have an account with us or are not registered with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide may only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons why we cannot comply with a request, if applicable. For data portability requests, we will endeavor to select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

    We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

    1. Personal Information Sales Opt-Out and Opt-In Rights

    If you are sixteen (16) years of age or older, you have the right to direct us to not sell your Personal Information at any time (the “right to opt-out”). Our business, as a business-to-business (“B2B”) provider, is targeted to business professionals. Therefore, we do not collect or sell the Personal Information of consumers we know are less than sixteen (16) years of age. If we learn that we have inadvertently collected the Personal Information of someone under the age of 16, we will immediately terminate the associated account and delete any data in connection with such registration and the user’s activity.

    Consumers who opt-in to Personal Information sales may opt-out of future sales at any time.

    In order to provide you with our services, it is necessary for us to provide and personalize ads, content, and communications based on your use of websites, including with information regarding your interests and your online interactions. If you request that we “do not sell” your Personal Information, as described in this Privacy Notice for California Residents (and our Privacy Policy), you will not be able to use any services we offer that require the continued use of the your business email address, such as maintaining your member account and providing you access to our free Premium Services. Accordingly, members who utilize the “Do Not Sell My Personal Info” link on our websites will be presented with the option to delete their account with CLIA and their associated Personal Information. If you make this request, you will still be able to access all the information and content that we offer on our websites to non-members. Further, you may register a new account with our websites at any time using a new corporate email address.

    1. NONDISCRIMINATION

    We will not discriminate against you for exercising any of your CCPA rights. We may choose in the future to offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects.

    California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our websites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.   • International transfers

    CLIA are an international association with members all over the world and, as such, the data we collect may be transferred to, and stored at, a destination outside the European Economic Area (EEA). All our data is stored on our server based in Washington, USA. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services

    In compliance with the GDPR, whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it as would be the case within the EEA by ensuring at least one of the following safeguards is implemented:

    • we will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.   • Data security

    We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

    We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

  • Data retention

    How long will you use my personal data for?

    We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

    • To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
    • By law we have to keep basic information about our Members (including Contact, Identity, Financial and Transaction Data) for six years after they cease being Members for tax purposes.

  • CONTROLLING Your personal data

    At your request, we will: (a) inform you of what personal data we have on file for you; (b) amend the personal data that we have on file for you; and/or (c) remove personal data that you have provided to us, or that we have collected.   • No fee usually required

    You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

  • What we may need from you

    We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

  • Time limit to respond

    We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

  • LAWFUL BASIS
    • Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).     • Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

  • YOUR LEGAL RIGHTS

    If you are an individual that visits our website from the European Economic Area or Switzerland, you are afforded the following rights:

    Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

    Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

    Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

    Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

    Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

    Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

    Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
